Description:

Attorney & Director of Pre-Litigation – Plaintiff Wage & Hour

The Opportunity

We are a plaintiff-side wage and hour class action law firm based in San Diego (with offices in San Diego and Seattle) looking for a highly strategic Attorney, Director of Pre-Litigation Department.

If you have exceptional instincts for winning cases and deep expertise in employment law, this is your chance to step out of the daily litigation grind and step into a crucial leadership role. Whether you prefer to work 100% remotely or in a hybrid capacity (San Diego Office), we offer a great work-life balance: no billable hour requirements, strictly business hours (8:30 AM to 5:00 PM), and no nights or weekends.

The Position & Responsibilities

As the Director of Pre-Litigation, you will be the strategic gatekeeper and leader of our frontline operations. You will oversee a dedicated pre-litigation department that includes law clerks and a full-time attorney dedicated to case assessments and legal research. Your core responsibilities will include:

  • Acting as the ultimate decision-maker on case viability once the intake team obtains the client file.
  • Managing and mentoring the pre-litigation team (law clerks and a research attorney).
  • Researching and determining viable legal claims under state wage and hour laws (primarily CA and WA, but others too) and federal law.
  • Overseeing the drafting of complaints and PAGA notices to ensure top-tier quality and accuracy and to meet monthly metrics.
  • Analyzing employee agreements to make strategic, critical decisions regarding arbitration enforceability.

Qualifications

  • Extensive knowledge of California employment law, specifically wage and hour class actions, PAGA, and the FLSA.
  • Ability and desire to manage and oversee a legal team and keep them on track.
  • A sharp analytical mind capable of quickly assessing case viability, damages, and potential pitfalls (especially regarding arbitration clauses).
  • Prior experience drafting, reviewing, or managing wage and hour complaints and PAGA notices.
  • Excellent legal research and writing skills, with a meticulous eye for detail.

Compensation & Perks

  • Pay: Base pay ($160,000 to $225,000 D.O.E.) + bonus opportunities.
  • Work-Life Balance: Strictly 8:30 AM to 5:00 PM, Monday to Friday. No nights, no weekends, no billable quotas.
  • Flexibility: 100% Remote or Hybrid (For hybrid: typically 2 days from home in San Diego).
  • Benefits: Health insurance, 401(k), Paid Time Off (PTO), and paid sick time.
  • Support: Tax-free WFH tech stipend / 2802 reimbursement.

About Us

Since 2018, we have recovered substantial compensation for employees throughout California and the United States under the California Labor Code, Private Attorneys General Act (PAGA), and Fair Labor Standards Act (FLSA).
